Changes to the license models
What DALICC changed in its curated models, when, and why.
A license model is corrected when a reading of the legal text turns out to be wrong. Every correction changes what the compatibility checker answers, so each change below names the reason behind it and links to the record it was made on.
677 changes with the reason "Review finding", page 10 of 14.

changed Target asset types: Creative work (i.e. text, picture, sound, movie), Dataset
was Target asset types: Creative work (i.e. text, picture, sound, movie)
Review finding The record targeted dalicc:CreativeWork only, while the 4.0 International parent CC-BY-ND-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port licenses database rights in its own words, so the asset type is text supported rather than merely plausible. Article 1 brings a database inside the licensed work: "Voor de toepassing van deze Licentie wordt onder het Werk mede verstaan de geluidsopname in de zin van de Wet op de naburige rechten en de databank in de zin van de Databankenwet", the Dutch statute that implements the sui generis database right of directive 96/9/EC. The grant in article 3 then carries "het opvragen en hergebruiken van het Werk", the extraction and re-utilisation right itself, and the preamble names "het databankenrecht" among the rights protecting the work. Added dcmitype:Dataset.

Review finding Section 5 of the Korean port covers the disclaimer of warranty and the limitation of liability in two sentences under one heading. The record held the whole two sentence block twice, once in dalicc:WarrantyDisclaimer and once in dalicc:LiabilityLimitation. Each field now holds its own sentence, quoted verbatim: the first sentence, in which the licensor offers the work as is and gives no warranty, is the disclaimer, the second, in which the licensor accepts no liability for damage arising from the licence or from use of the work, is the limitation.

was Target asset types: Creative work (i.e. text, picture, sound, movie)
Review finding The record targeted dalicc:CreativeWork only, while the 4.0 International parent CC-BY-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port settles the sui generis database right expressly. Section 1 defines "Opera" to include "o baza de date in conformitate cu definitiile din legislatia in vigoare privind drepturile de autor si drepturile conexe" (a database as defined by the copyright and neighbouring rights legislation in force), Section 3 grants "in cazul in care opera este o baza de date, dreptul de a extrage si/sau a reutiliza parti substantiale din Opera" (where the work is a database, the right to extract and reuse substantial parts of it) and closes with "Daca Licentiatorul este titularul drepturilor sui-generis asupra unei baze de date, in conformitate cu legea nationala care implementeaza Directiva Europeana privind Bazele de Date, Licentiatorul va renunta la aceste drepturi" (if the Licensor holds sui generis database rights under the national law implementing the European Database Directive, the Licensor waives them). Section 4 adds that the restrictions do not apply to the parts of the Work that qualify only under the Romanian sui generis database right. Because the legal text names databases as licensed subject matter and disposes of the database maker's right in the grant itself, dcmitype:Dataset was added here rather than left as a proposal, which is how the same question was decided for the Portuguese, Czech and Azerbaijani ports. The ports in this review group whose text has no database clause at all, Ecuador and Brazil, keep the proposal.

Review finding The record targeted dalicc:CreativeWork only, while the 4.0 International parent CC-BY-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port settles database rights expressly: the last sentence of Section 3 waives the sui generis right, so that where the Licensor holds the exclusive rights of Chapter III of Decreto-Lei 122/2000, which implements Directive 96/9/EC in Portuguese law, the Licensor "declara expressamente renunciar a esses direitos", and Section 4(e) adds that the restrictions do not apply to the parts of the Work protected only by that database maker's right. Beyond that, the definition of "Trabalho" in Section 1 names "uma base de dados que, pela seleção ou disposição do respetivo conteúdo, constitua uma criação intelectual" and "um programa de computador" among the licensed subject matter. Because the legal text names databases as licensed subject matter and disposes of the database maker's right in the grant itself, dcmitype:Dataset was added here rather than left as a proposal. Review finding The record targeted dalicc:CreativeWork alone, while the 4.0 International parent CC-BY-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port licenses database rights expressly. Paragraph 3 lists "Pobieranie danych z Utworu oraz ich wtórne wykorzystanie" (extraction of data from the work and its re-utilisation) as one of the fields of exploitation granted, and the paragraph closes with the licensor waiving the sui generis right under the law implementing Directive 96/9/EC of 11 March 1996: "Licencjodawca zrzeka się tego prawa", with an undertaking not to exercise it where the waiver is ineffective. Paragraph 4(e) adds that the restrictions in 4(a) to 4(d) do not apply to a work, or a part of one, that is a work under this licence only because it is a database that is not itself an authored work. Because the grant of the database right is explicit in the text, dcmitype:Dataset was added rather than proposed.

Review finding The record targeted dalicc:CreativeWork only, while the 4.0 International parent CC-BY-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port settles the sui generis database right expressly. Section 1 defines "Frembringelse" to reach beyond works under section 1 of the Norwegian Copyright Act to subject matter protected under "åndsverksloven kapittel 5", the chapter on neighbouring rights that contains the database and catalogue right of section 43. Section 3 closes with "Dersom lisensgiver innehar databaserettigheter eller lignende i henhold til aandsverklovens section 43 og EUs databasedirektiv, fraskriver lisensgiver seg disse rettigheter" (if the licensor holds database rights or the like under section 43 of the Copyright Act and the EU database directive, the licensor waives them). Section 4(e) adds that the restrictions do not apply to the parts that fall inside the definition only because they meet those criteria. Because the legal text names databases as licensed subject matter and disposes of the database maker's right in the grant itself, dcmitype:Dataset was added here rather than left as a proposal, which is how the same question was decided for the Portuguese, Czech and Azerbaijani ports. The definition of Werk in article 1 says that for the purposes of the licence the Werk also means the phonogram, the first fixation of a film, the broadcast programme and the databank in the sense of the Databankenwet, insofar as they are protected in the jurisdiction of the user; the definition of Maker includes the producer of a databank; the article 3 grant includes the right to extract and re-use the Werk and waives the licensor own exclusive rights under the national law implementing the European database directive; and article 4 carves the restrictions out of the parts that qualify only under the sui generis database right. Review finding dalicc:WarrantyDisclaimer and dalicc:LiabilityLimitation are quoted from the Italian text of this port and not from the English unported version, and each field holds its own clause rather than a copy of the other. Article 5, Dichiarazioni, Garanzie ed Esonero da responsabilita, is the warranty disclaimer and article 6, Limitazione di Responsabilita, the limitation, both in capitals. The Italian limitation ends with a sentence the unported text does not have: "NESSUNA CLAUSOLA DI QUESTA LICENZA ESCLUDE O LIMITA LA RESPONSABILITA NEL CASO IN CUI QUESTA DIPENDA DA DOLO O COLPA GRAVE." Each field holds its own article. One transcription defect was corrected: the disclaimer field read "COSI COME" where the legal code reads "COSI COM'E", a dropped apostrophe inside the quoted text. All six Italian records carried it.

Review finding The record carried cc:legalcode but no dct:source. The legal-code page states the canonical URL of the licence, https://creativecommons.org/licenses/by/3.0/ie/, and the six 4.0 International parents carry exactly that pair, legal code plus deed. Added.

Review finding The record targeted dalicc:CreativeWork alone, while the 4.0 International parent CC-BY-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port names a database as licensed subject matter in its own text: clause 3(e), in English rendering, grants the right "to make any use of a substantial part of the contents of a database, in the case where the licensed subject matter is a database", and clause 3 adds that where the Licensor holds the sui generis right of the database maker under Greek copyright law implementing Directive 96/9/EC, the Licensor waives that right. Clause 4(e) exempts the parts covered only by the sui generis right from the restrictions. Since the text is explicit, dcmitype:Dataset was added here rather than left to the library wide decision that covers the ports whose text says nothing about databases.
