What DALICC changed in its curated models, when, and why.

A license model is corrected when a reading of the legal text turns out to be wrong. Every correction changes what the compatibility checker answers, so each change below names the reason behind it and links to the record it was made on.

    Review finding The record targeted dalicc:CreativeWork only, while the 4.0 International parent CC-BY-NC-SA-4.0 targets dalicc:CreativeWork and dcmitype:Dataset. This port licenses database rights in terms. The definition of Werk in article 1 says that for the purposes of the licence the Werk also means the phonogram, the first fixation of a film, the broadcast programme and the databank in the sense of the Databankenwet, insofar as they are protected in the jurisdiction of the user; the definition of Maker includes the producer of a databank; the article 3 grant includes the right to extract and re-use the Werk and waives the licensor own exclusive rights under the national law implementing the European database directive; and article 4 carves the restrictions out of the parts that qualify only under the sui generis database right. Since the text is explicit, dcmitype:Dataset was added, which also brings the record into line with its parent.

Section 3 grants "Lorsque l'Oeuvre est une base de donnees, extraire et reutiliser des parties substantielles de l'Oeuvre" and closes with "Si le Donneur de Licence est le titulaire de droits de base de donnees sui generis suivant la transposition en droit national de la Directive Europeenne sur les Bases de Donnees, le Donneur de Licence renonce a ces droits". Section 4(f) adds that the restrictions of 4(a) and 4(b) do not apply to the parts of an Oeuvre that fall inside the definition only because they are governed by that sui generis right. Because the legal text names databases as licensed subject matter and disposes of the database maker's right in the grant itself, dcmitype:Dataset was added here rather than left as a proposal, which is how the same question was decided for the Portuguese, Czech and Azerbaijani ports. The ports in this review group whose text has no database clause at all, Ecuador and Brazil, keep the proposal.
